Scope and Content: The Records Conservation Board is responsible for approving the disposition of all state records except those created by the legislative and judicial branches of government.  Series is created to record the board’s decisions concerning disposition schedules and requests for destruction or transfer permission submitted by agencies and records analysts.

Scope and Content: As custodian of the foundation records of Massachusetts, the state secretary is responsible for binding and maintaining engrossed copies of acts and resolves of the General Court (MGLA c 3, s 23).  Since 1978 responsibility for binding has been carried out by the Regulations Division of the secretary’s office.  Once the binding is completed, the volumes are transferred to the Archives.   Engrossed acts are the original parchment acts passed by the General Court. –See also: Massachusetts. Scope and Content: Since 1941 governors of the Commonwealth have issued executive orders, to 1964 (along with administrative orders) usually in conjunction with the Wars Powers Acts of 1941 and 1942 and the Civil Defense Act of 1950; and more recently to effect changes in state agency organization and administration.  As record keeper of the Commonwealth, the state secretary (since 1976 through the Massachusetts Regulations Division or Rules and Regulations Division) maintains and publishes the orders pursuant to MGLA c 30A, s 6.

Scope and Content: The state secretary has since 1917 had responsibility for filings of  regulations promulgated by state agencies.  From 1975 (more formally since 1978) a Rules and Regulations  Division (currently called the Massachusetts Regulations Division) within the secretary’s office has been charged with maintaining these filings and since 1976 with publishing them and other documents in the biweekly Massachusetts register, as mandated by MGLA c 30A, s 6.

Scope and Content: The Division of Administrative Law Appeals in the Executive Office for Administration and Finance (known until 1983 as the Division of Hearings (or Hearing) Officers) hears appeals filed to contest rates set by the Rate Setting Commission for health care providers in the Commonwealth (Massachusetts Rate Setting Commission. Public hearing records, 1962-1989 ((M-Ar)1951)).  A copy of each of the division’s decision in such appeals must be filed in the state secretary’s office.  Filings were maintained by the Public Records Division until mid-1975, when the Massachusetts Regulations Division (or Rules and Regulations Division) assumed responsibility for them.  Decisions contain letter of transmittal and attested text of the decision, which includes the following information:  appellant, what is being appealed, appeal number, who appeared for appellant and respondent at hearing, name of hearing officer, text of decision, and name of preparer.

Scope and Content: The state secretary has since 1917 had responsibility for filings of regulations promulgated by state agencies, which from 1971 to 1975 was carried out by the Public Records Division.  From 1975 (more formally since 1978) the Rules and Regulations Division (currently called the Massachusetts Regulations Division) within the secretary’s office has been charged with these filings.  Regulation files contain regulations and amendments to regulations transmitted to the secretary’s office for filing and publication in the Massachusetts register and the Code of Massachusetts Regulations in accordance with MGLA c 30A, ss 5-6A.

Scope and Content: The Secretary of the Commonwealth of Massachusetts is responsible, through the Securities Division, for regulating activities of persons and companies in the securities business in accordance with the Massachusetts Uniform Securities Act (MGLA c 110A) and regulations promulgated thereunder. The Securities Division adopts and periodically updates regulations to ensure that investors are adequately protected and that unreasonable burdens on legitimate capital raising activities are avoided. –Stockbrokers and brokerage firms must be registered with the Securities Division in order to engage in business in Massachusetts. The division also licenses financial planners and investment advisors. Additionally, stock offerings and other types of investments may have to comply with certain disclosure requirements before being sold in this state. Division staff ensure that there is compliance with applicable state laws and investigate citizen complaints about the fraudulent sale of securities by stockbrokers and issuers. The division often coordinates its activities with other state and federal regulatory agencies.  The division includes corporate finance, licensing, and enforcement sections.

Scope and Content: The commission has the statutory authority to investigate objections as to the legality, validity, completeness, or accuracy of nomination papers or actions required by law to give access to a state ballot, or to place an initiative or referendum question on a state ballot; and to render a decision on any matter referred to it (MGLA c 55B, s 10).  Case files document the resolution of individual complaints regarding access to the ballot.

Scope and Content: The State Ballot Law Commission renders decisions concerning objections to validity of nomination papers or other actions placing candidates or initiative/referendum questions on the ballot (MGLA c 55B, s 4).  Until passage of St 1980, c 134, s 8, jurisdiction extended to public policy questions on such ballots.  This series concerns the challenge of Charles H. McGlue et al. to placing on the 1964 ballot a referendum question to repeal or suspend a legislative pay raise because of fraudulent signatures.
